State Rep. Pricey Harrison has introduced a bill designed to repeal tax exemptions specific to data centers, aiming to apply sales and use tax requirements to them as they apply to other businesses, according to the North Carolina State House.

HB 1213, titled ‘Protect Taxpayers and Consumers,’ was formally submitted on April 30 in the regular 2025 session.

Fundamentally, this legislation proposes to cut several North Carolina sales and use tax exclusions benefitting data centers. By eliminating specific subdivisions in General Statutes sections 105-164.13 and 105-164.3, the bill would do away with definitions and exemptions previously allowing qualifying data center facilities and related items to avoid sales and use tax. Instead, data centers and related transactions would be taxed consistent with other businesses. Section 1 applies to sales on or after July 1, 2026, while additional sections take effect once the law is enacted.

Among the three bill sponsors, Harrison introduced the most measures—68—during the 2025 regular session.

North Carolina’s legislative process for bills follows a multi-step procedure before a proposal becomes law. Legislation begins with a filing by a lawmaker, is reviewed in committee, and requires three readings in each chamber. If the chambers approve differing versions, both must reconcile and pass identical text. After passage by both bodies, the bill moves to the governor, who has 10 days to act (or 30 if the legislature is out of session), by signing, vetoing, or permitting it to become law without signature.
